This policy applies to all orders placed via brightrsleep.de and is governed by §§ 312 ff., 355 ff., 434 ff. German Civil Code (BGB) and the EU Consumer Rights Directive 2011/83/EU. It supplements the Terms & Conditions of Brightr® Sleep.

Consumers have the right to withdraw from this contract within 14 days without giving any reason (§ 355 BGB in conjunction with Art. 9 EU Directive 2011/83/EU).

1.1 Withdrawal period

The withdrawal period is 14 days from the day you, or a third party named by you (who is not the carrier), take possession of the goods.

For orders with multiple items delivered separately, the period begins upon receipt of the last item.

1.2 Exercising the right of withdrawal

To exercise your right, you must inform us with a clear statement (e.g. email or online form):

To meet the deadline, it is sufficient to send your withdrawal notice before the 14-day period expires.

1.3 Consequences of withdrawal — Refund

We will refund all payments received, including delivery costs (except additional costs resulting from choosing a more expensive shipping method), without undue delay and no later than 14 days after receiving your withdrawal notice.

Refunds will be made using the same payment method as the original transaction, unless otherwise agreed. No fees will be charged.

We may withhold the refund until we have received the goods or proof of return.

1.4 Return of goods

You must return the goods without undue delay and no later than 14 days after notifying us of your withdrawal.

You meet the deadline if you send the goods before the 14-day period expires.

  • You bear the direct cost of return shipping
  • You are only liable for any diminished value resulting from handling beyond what is necessary to check the nature, characteristics, and function of the goods

Return address will be provided after return authorization (Netherlands warehouse).

1.5 Exclusion of withdrawal right for opened hygiene products (§ 312g (2) No. 3 BGB)

The right of withdrawal expires early for goods that are not suitable for return for hygiene or health protection reasons if the seal has been removed after delivery.

This applies in particular to:

  • Pillows and pillow covers (opened packaging)
  • Mattress toppers removed from vacuum-sealed packaging
  • Mattress protectors, bed linen, covers, and bedding accessories

👉 Please keep the original packaging if you are considering a return.
Once the seal is opened, the statutory withdrawal right no longer applies.

2. Voluntary Withdrawal — 100-Day Return Policy

In addition, Brightr® Sleep offers a voluntary return policy of 100 days from delivery (14 days statutory + 86 days voluntary).
This is a goodwill policy and does not limit your legal rights.

You may return mattress toppers within 100 days and pillows within 30 days via our returns portal or by email without giving a reason.

A break-in period is normal. We recommend allowing your body 4–6 weeks to adjust.

2.1 Conditions of voluntary returns
  • Product must be clean, undamaged, and without visible signs of use
  • Mattress toppers must be used with a protector during the trial
  • Pillows must be used with a pillowcase
  • Product must be shipped within 14 days after return approval
  • Customer pays return shipping
2.2 Refunds (voluntary return)

We refund all payments, excluding delivery costs, within 14 days after receiving the goods or proof of return.

Refunds are made using the original payment method.

2.3 Possible deductions

We reserve the right to deduct:

  • €50 cleaning fee if the product requires restoration
  • Cost of replacing damaged covers
  • Proportional value reduction for opened vacuum-sealed goods (§ 357 (7) BGB)
2.4 Exclusions from voluntary return

Voluntary returns are excluded if:

  • The product shows signs of use beyond normal testing (e.g. stains, odors, deformation, wear)
  • The product was used without a protective cover
  • Improper handling occurred (force, overload, moisture, mold, modifications)
  • Abuse is suspected (e.g. repeated promotional returns)
  • Links to competing sleep brands exist
  • Fraudulent behavior is detected

2.5 Procedure if return is rejected

If conditions are not met, you will be notified within 8 working days.

You then have 14 days to:

  • Collect the product, or
  • Arrange return shipping at your own cost

If no action is taken, we may dispose of the product after further notice without liability.

3. Value reduction for vacuum-packed goods

Mattress toppers and pillows are vacuum-sealed for hygiene reasons.

You may open the packaging to inspect the product.

However, opening reduces value, as the product cannot be restored to its original hygienic condition.

Refunds may be reduced proportionally according to § 357 (7) BGB.

If products show excessive use, we may:

  • Partially refuse the return, or
  • Reduce the refund

If resale is no longer possible, return may be refused entirely.

4. Returns for promotions & bundles
4.1 Quantity discounts

All items must be returned for a full refund.
If only part is returned, remaining items will be charged at full retail price.

4.2 BOGO (1+1 free – same product)

Both items must be returned for full refund.
If one is kept, it will be charged at 50% of retail price.

4.3 BOGO (1+1 free – different products)

Both must be returned for full refund.
If one is kept, it will be charged at 50% of its retail price.

5. Warranty (Defects) — §§ 434 ff. BGB

If you notice a defect, contact us immediatelly.

  • Firmness preference
  • Minor cosmetic issues
  • Temporary product odor
  • Foam discoloration
  • Improper use or wear and tear
5.4 Examples of valid defects
  • Cracks or internal damage upon opening
  • Broken zipper
  • Product not expanding to correct size
5.5 Processing

Solutions are provided within 14 days after defect confirmation

Order Cancellation

You can cancel your order as long as it has not yet been dispatched. Please contact us as soon as possible at hello@brightrsleep.de.

Once your order has been dispatched, cancellation is no longer possible. In this case, you can return the item under your 14-day right of withdrawal after delivery.
